Legal issues Christians face during retirement

"This is the covenant I will make with them after that time, says the Lord. I will put my laws in their hearts, and I will write them on their minds." Hebrews 10:16 (New International Version)

Every person or family needs certain legal documents for asset protection.  The most common are listed below.

Will

A will is one of the most important legal documents you need.  Your will establishes who controls or who receives your property upon your death.  In addition, if you have dependent children living with you at the time of your death, your will makes provision for their care and upkeep.

Without a doubt, your will is probably the most important legal document you will ever sign.  If you should die without a will you cause the state in which you reside to have to disperse your property and estate.  You are in a much better position to make better decisions about your estate than a judge or court-appointed attorney who never even knew you or anything about you.

A will usually names someone to serve as executor of one's estate.  The person that you choose as executor is the person who will be responsible for carrying out your last wishes.  By law, they are obligated to carry out your wishes exactly as your will directs.

It is estimated that at least two-thirds of adults in America do not have a will.

Living Trust

A Living Trust is similar to a Will in that it allows you the option of  transferring your personal property to your heirs or the people of your choice upon your death.  A Living Trust offers a few advantages over a will.

  1. Living Trust enables your real estate and other property to be transferred to your heirs without incurring many of the normal costs associated with probating a will.
  2. A Living Trust is preferred by some because it is usually able to be settled much quicker than a Will.
  3. A Living Trust may be able to save your estate a portion of the taxes normally associated with the probation of a Will.

Power of Attorney

Granting someone power of attorney allows you to designate someone you trust to make financial and legal decisions on your behalf should you become incapacitated or unable to make those decisions for yourself.

You may choose to grant that power to a trusted family member or friend, and you may dictate the terms you wish to have enforced on your behalf.

Living Will

A Living Will is a legal document which states your preferences that you decided in advance concerning life support and resuscitation issues.  This document is designed to become your voice and is designed to instruct health care providers to carry out your wishes and what to do in the event you become incapacitated.  One of the major advantages of having a Living Will is that of relieving your spouse or children of having to make difficult decisions concerning life support should your physician determine that you cannot survive without life support.
